Please read these terms carefully before using our services

1. Definitions

Term Meaning
Affiliate Any entity that directly or indirectly controls, is controlled by, or is under common control with Ascend.
Campus Programmes Post Graduate Programme in Construction Business Management (PGPCBM) and Post Graduate Programme in Real Estate Transactions & Advisory (PGPRETA), delivered primarily oncampus in Bengaluru.
Online Programme Post Graduate Programme in Construction Project Management (PGPCPM) delivered via distancelearning modalities.
Content All text, graphics, audio, video, code, data sets, downloadable files, or other materials provided by Ascend excluding User Submissions (defined in § 12.4).
Placement Guarantee Ascend’s conditional undertaking in § 11 to procure qualifying employment opportunities for eligible Learners.
Placement Partner An employer or recruiter that has executed a written engagement with Ascend to interview and potentially hire Learners.
Website Any internet domain or subdomain operated by Ascend, including ascendblr.org and successors.

2. Interpretation

2.1 Hierarchy. If a conflict exists, the following descending order of precedence applies: (a) any nonwaivable statutory right; (b) a bespoke written contract signed by both parties; (c) these Terms; (d) the Privacy Policy; (e) any Programme-specific handbook or Code of Conduct.

2.2 Headings. Clause headings are for convenience only and do not affect interpretation.

2.3 Illustrative Language. “Include,” “including,” and similar terms are illustrative, not exhaustive.

3. Modifications to Terms

Ascend may amend these Terms at any time. The revised Terms will be posted on the Website with an updated Effective Date. Continued use after that date constitutes acceptance. Material changes affecting Fees, the Placement Guarantee, or dispute resolution will, where practicable, be preceded by at least seven (7) days’ notice by email or dashboard banner.

4. Eligibility and Capacity

  • Age. You must be at least 18 years of age and possess full contractual capacity.
  • Professional Prerequisites. Specific Programmes may require a civil engineering, architecture, or allied degree; Ascend may verify credentials.
  • Territorial Reach & Export Control. Ascend markets and enrols Learners domiciled in India, the UAE, and Saudi Arabia. Residents of jurisdictions subject to trade or export sanctions, embargoes, or similar restrictions are ineligible. Ascend may decline enrolment from any other territory absent written authorisation.

5. Account Registration & Security

You warrant that all information supplied is accurate and current and agree to maintain confidentiality of login credentials. Ascend may require identity verification; failure to furnish documents within five (5) calendar days may result in suspension.

6. Programme Nature & Academic Disclaimers

  • Certificates, Not Degrees. Ascend certificates confer no university credits or statutory licences.
  • Collaborations. Industry cobranding does not create accreditation beyond explicit statements.
  • No Guaranteed Outcomes. Ascend does not guarantee specific skill mastery or income increase beyond the Placement Guarantee benchmarks.

7. Fees, Payment, and Fiscal Incidence

7.1 Quoted Fees

All published fees include Indian GST. Customs duties, crossborder bank fees, and FX charges are your responsibility.

7.2 Permitted Payment Methods

Fees are payable solely via bank transfer (IMPS/NEFT) or UPI or cash to the account on your invoice. Cards and ewallets are not accepted in most cases.

7.3 Instalments & Extensions

Instalment plans require Ascend’s written approval based on documented extenuating circumstances.

7.4 Late Payment Consequences

Overdue instalments accrue liquidated damages at the lesser of (a) INR 500 per day or (b) 1% of the overdue amount per week, capped at 10% of that defaulting instalment. These amounts are a genuine preestimate of administrative costs. If a competent court deems them excessive, they shall be reduced to the maximum “reasonable compensation” permitted under § 74 of the Indian Contract Act 1872.

If arrears exceed seven (7) days or INR 10,000, Ascend may—after seven-day notice—suspend LMS access, withhold documents, void the Placement Guarantee, and/or terminate enrolment. Outstanding principal and liquidated damages remain due.

8. Refunds & Cancellations

  • General Rule. Fees are nonrefundable once paid.
  • Statutory CarveOut. Where nonwaivable consumer law mandates a remedy for service deficiency, Ascend will first attempt rectification or reperformance; failing which, a proportionate refund or credit will be issued.
  • Medical Emergencies. Ascend may, at its discretion, grant partial or full fee credit upon timely submission of substantiating medical documentation. Ascend’s decision is final subject to any mandatory statutory rights.
  • Request Procedure. Written refund/credit requests must be lodged within thirty (30) days of the triggering event; Ascend will acknowledge within seven (7) days and decide within thirty (30) days thereafter.
  • Effect on Guarantee. Any refund or credit terminates the Placement Guarantee.

9. Technical Requirements & Continuity

Learners must maintain hardware minimally comprising Intel Core i3 (8th gen) CPU, 4 GB RAM, 128 GB storage, Windows 10+, and 8 Mbps connectivity. Ascend targets 99% uptime but is not liable for outages beyond reasonable control. During force majeure events, Ascend may migrate delivery online or reschedule without refund.

10. ArtificialIntelligence Tools

Al outputs may be inaccurate or biased; professional verification is required. Al content does not constitute professional advice. This disclaimer supplements § 16.

11. Placement Guarantee

11.1 Eligibility Criteria

11.2 Benchmarks

  • Fresh Graduates: Minimum gross CTC INR 4 lakh p.a.
  • Experienced Professionals: ≥ 30% uplift on verified prior gross CTC (excluding ESOP/stock).

11.3 Interview Cadence

  • Phase I: ≥ 5 interviews within 45 days of enrolment.
  • Phase II: one fresh interview every two (2) weeks after each rejection until qualifying offer or Phase III.
  • Phase III: second intensive drive within six (6) months post-Programme.

11.4 Exhaustion & Waiver

Guarantee terminates upon first qualifying offer or Learner’s breach (e.g., rejecting offer, unauthorised employer contact, deliberate underperformance).

11.5 Remedies

If no qualifying offer after Phase III and full compliance by Learner, Ascend will (a) continue support six (6) months, then (b) refund 100% tuition within sixty (60) days if still unsuccessful.

11.6 Post-Placement Disclaimer

Ascend’s obligations cease on Learner’s joining date. Subsequent employer–employee disputes lie solely between those parties.

12. Intellectual Property & User Content

12.1 Ascend Content Ownership

All Ascend Content is owned by Ascend or licensors and protected by Indian and international IP statutes.

12.2 Limited Personal Licence

Revocable, nonexclusive, nontransferable licence for personal, noncommercial study.

12.3 Prohibited Acts

Republishing, selling, sublicensing, duplicating beyond personal use, redistributing, or using Ascend Content to build competing products is forbidden.

12.4 User Submissions

User Submissions are user views; Ascend disclaims liability. Ascend may moderate or remove submissions at its discretion.

12.5 Submission Warranties

Poster warrants ownership, noninfringement, lawfulness, and grants Ascend an irrevocable, worldwide, royalty-free licence to use submissions.

12.6 Recording & Likeness Licence

Courses may be recorded. By participating, you grant Ascend a perpetual, worldwide, royalty-free licence to use your image, voice, name, likeness, and contributions in any medium for educational, promotional, or archival purposes and waive any moral rights except that Ascend will not disclose sensitive personal data without additional written consent.

12.7 Institutional Use of Learner Likeness & Classroom Material

13. Acceptable Use & Code of Conduct

You shall not upload malware, harass others, scrape data, impersonate staff, infringe IP, spam users, circumvent security, or undermine academic integrity. Ascend may suspend or report accounts.

13.1 Code of Conduct (CoC)

Attendance ≥ 80%, academic integrity, professional behaviour, information accuracy, safety compliance. Violations may result in sanctions up to expulsion and forfeiture of the Placement Guarantee.

14. Privacy & Accessibility

Ascend processes data under the Digital Personal Data Protection Act 2023 and affords equivalent safeguards to UAE/KSA data subjects. Data may be shared with Placement Partners, collection agencies, or edtech vendors under contract; Ascend does not sell personal data. Records retained eight (8) years.

Accessibility. Ascend strives to meet WCAG 2.1 AA standards. Accessibility requests may be directed to the Grievance Officer.

15. Third-Party Links & Services

External services are provided “as is”; dealings with third parties are at your own risk.

16. Disclaimer of Warranties

Services and Content are provided "AS IS" without warranties. No guarantee of uninterrupted service or specific outcomes beyond the Placement Guarantee.

17. Limitation of Liability

Ascend's total liability shall not exceed tuition actually paid during the twelve (12) months preceding the claim; indirect or consequential damages are excluded.

18. Indemnification

You agree to indemnify Ascend against claims arising from your breach, misuse, submissions, or law violation. Ascend may assume exclusive defence at its expense.

19. Force Majeure

Neither party is liable for failure caused by events beyond reasonable control (e.g., natural disasters, war, pandemics). Ascend will implement contingency measures where feasible.

20. Termination, Suspension & Survival

  • By Learner. Account may be terminated by written notice; fees remain nonrefundable subject to § 8.
  • By Ascend. Suspension/termination for breach, nonpayment, or dishonesty.
  • PostTermination Debadging. Within seven (7) days of withdrawal or expulsion you must remove all public claims of current Ascend affiliation (résumés, LinkedIn, websites). Noncompliance constitutes trademark misuse; Ascend may seek injunctive relief and publish clarifications.
  • Surviving clauses: §§ 79, 1218, 2025.

21. Governing Law & Dispute Resolution

These Terms are governed by Indian law. You and Ascend consent to exclusive jurisdiction of courts in Bengaluru, Karnataka. To the fullest extent permitted by law, class or representative actions are waived; if such waiver is held unenforceable, disputes shall proceed on an individual basis.

  • Notices to Learner: sent to the last email/postal address on file.

23. Severability & Waiver

If any provision is unenforceable, it shall be modified to the minimal extent necessary; remaining provisions survive. Ascend's failure to enforce any right is not a waiver.

24. Assignment

Ascend may assign its rights and obligations pursuant to merger, acquisition, or reorganisation. Learners may not assign without prior written consent; unauthorised assignment is void.

25. Entire Agreement

These Terms, the Privacy Policy, the Code of Conduct, and any Programme handbook constitute the entire agreement and supersede all prior understandings.
